Show Laws on the sale of tobacco products make it illegal for Victorian retailers to display or promote tobacco products or packaging anywhere on their premises. The statewide ban on the sale of tobacco products to persons under 18 also extends to vending machines on retail premises. Under the law, any vending machine that contains tobacco products must be visible to and monitored by retail staff. From 1 August 2017, the Tobacco Amendment Act 2016 will amend the Tobacco Act 1987 to regulate all e-cigarettes in the same way as tobacco products.

A person under 18 years of age can sell tobacco and e-cigarette products, however it is not recommended as they may be less confident about asking to see ID or refusing a sale.
Who can sell cigarettes in Australia?In Australia, tobacco retailers require a positive licence in all states except New South Wales, Queensland, and Victoria (see Table 11B. 2). Wholesalers must also be licensed in the Australian Capital Territory, the Northern Territory and Western Australia.
What are the laws in Victoria regarding the smoking of cigarettes?Under Victoria's Tobacco Act 1987 (the Tobacco Act), smoking is prohibited in all enclosed workplaces and certain public spaces where members of the public gather and may be exposed to second-hand tobacco smoke.
Can you smoke at 16 in Victoria?The prohibition on smoking includes the use of e-cigarettes (vaping) and applies whether or not the e-cigarette contains nicotine. Cigarettes and e-cigarettes cannot be sold to people under 18 years of age.
