Why This Matters

If you’re in line for a green card, it’s important to keep track of actual changes (and likely future developments) in the Visa Bulletin. It’s always a good idea to prepare all the documents needed for your green card application ahead of time, so you can be ready to file as quickly as possible once the Visa Bulletin shows that a green card is available to you. By failing to file in a month when a green card is available, you risk facing a surprise backward movement (“retrogression”) in the next Visa Bulletin, which would close your window of opportunity for filing a green card application. Will EB3 India move forward?

The future of India EB3 is unclear at the moment, but will likely not advance. At this time, it doesn't appear that India EB2 or EB3 will advance until sometime next year, with some analysts suggesting priority date movement won't be seen until March or April of 2023.

Will there be green card spillover in 2022?

First, the new fiscal year marks a new allotment of 140,000 employment-based green cards, plus an expected spillover of up to 60,000 unused family-based green cards. This means that USCIS and DOS will be under pressure to issue roughly 200,000 employment-based green cards over the next 12 months.

How long will it take for EB3 to be current?

As a general overview the EB3 processing time is anywhere from 1 to 3 years, but nationals of some countries may wait up to 10+ years.
